This is an Untenable Situation for Residents @ 380 Main Street.

The following is via The Aboriginal front Door, Smoke Signals and The Tattoo Society. No one spoke with or made consideration of the people who’s home this is.

It seems a flagrant disregard for the impact it would have on the residents @ Bruce Eriksen Place. Just yesterday the City of Vancouver put up a “patio” on Main street right in front of our apartment’s principal entrance.

Special Event Permitting Handbook – City Of Vancouver BEP was not afforded any of these considerations as prescribed by the city of Vancouver From: A guide to special event permitting on Vancouver streets, sidewalks, plazas, parks and civic spaces.”

Special Event Permitting Handbook – City Of Vancouver

There was no public notice posted or given. There was no consultation with residents either commercial and residential. The ability to park, have deliveries, to get in and out of a DATS bus or other such service in front of one’s home is gone, literally overnight and without any public notice. What happens if there is a Fire (VFD) or an EMT / Ambulance is needed?

What happens if one has to move in and or out of the apartment? How does one move furniture in or out? How do we feel safe and not obstructed as we negotiate a carnival like atmosphere, garbage, people eating and defecating in front of our door, and to have to be watching and hearing people fighting in the line up?

Where is the forethought or consideration for people in the apartments above when it comes to BBQ smoke wafting into their homes and having no choice but to listen to the blaring music coming from the loud speaker/s?

WHO IS GOING TO FEEL SAFE AND COMFORTABLE COMING AND GOING FROM ONES HOME WHEN THIS IS WHAT YOU HAVE TO FACE WHEN COMING AND GOING?

The line up goes down the block and the main bottle neck is right in front of the residents principle entrance.

HERE WE SEE SOME ONE WASHING THEIR HAIR OUTSIDE THE ENTRANCE WHILE FOOD IS BEING PREPPED RIGHT IN FRONT OF THEM.

There WAS NO TRASH RECIPROCALS PROVIDED FOR THE FOOD LINE. THE ONLY GARBAGE CAN WAS THE ONE (CITY OF VANCOUVER PROVIDED) AT THE END  OF THE BLOCK WHICH WAS FULL HALF WAY THROUGH THE BBQ

There has been 1/2 a dozen people speaking up about what has just happened and this is within hours of this “BBQ” starting today alone!

How much do we have to bear? We have No. 2 fire station 1 block away and we deal with sirens several  times daily  and nightly that come from them being dispatched. We have Ambulance and Police sirens several a times a day and through out the night with sirens blaring.

There are several buses that run between Cordova and Hasting on Main, commercial  / construction vehicles, rush hour traffic and tent city people camping out in front of the building, defecating and urinating on our door step. We cannot even have a bike rack any longer out in front.

And now this… This is not peaceable enjoyment and I am calling on NHS, The City Of Vancouver, Vancouver fire Department and The Vancouver Police to provide us with some relief.

Would this go over well in West Vancouver, The West End, Kitsilano, etc.? Would they just sit there as a free for all food line up popped up in front of their Condo?  No they would not.

We who have our homes here have taken the brunt of many things that erode our quality of life and or  peace and it is time that we are given the due and proper consideration that is required in this situation. Many residents cannot afford to move, for if they could, many would.

We are an apartment building, not an SRO, we have people with disabilities and working people alike. We do not have police or emergency services called here on a routine basis. We are a peaceable group of residents and we have reached a limit of how much we can take on the encroachment and now the clearly detrimental actions taken by the city and certain non profits to our peaceable enjoyment of our tenancy.

We will first seek a resolution  leading to an abatement of the issues and hope to achieve that quickly outside the courts, and if not, then seek third party involvement to get a legal remedy if that is what is advised, applicable, and or required.

We need to talk and be proactive about AFD and it’s impact on the 300 block of Main Street – Our Home.

#TerraHousing Why is it that Bruce Eriksen Place, The Oasis @ 40 East Hastings is no longer featured on your property management portfolio / website?

  1. Quiet Enjoyment

As part of the tenancy agreement, tenants have a right to peace, quiet and privacy in their homes – a right that comes from the common law principle of quiet enjoyment. That means every tenant has the right to:
    Freedom from unreasonable disturbance
    https://www2.gov.bc.ca/gov/content/housing-tenancy/residential-tenancies/during-a-tenancy/quiet-enjoyment

The Aboriginal Front Door is a Tenant of N.H.S.

    1. The Basics

According to Section 28 of the Residential Tenancy Act (RTA), the principle of “quiet enjoyment” ensures that every BC tenant has the right to:

      • reasonable privacy;
      • freedom from unreasonable disturbances;
      • exclusive use of their rental unit (except in situations where the RTA allows a landlord to enter); and
      • use of common areas for reasonable purposes, free from significant interference.

  2. This is the mail I sent to NHS and the board:

I have had no less than 6 people speak with me about what is going on just this afternoon. Some are truly worried about safety. No one and I mean no one signed up for this.

I will be polling all residents, especially those who have their apartments facing onto mainstreet.

In looking at Terra's website Bruce Eriksen is No longer listed in their portfolio of properties. Who is our property management company?

I will be talking to VFD, VPD, VTU, and Jean Swanson. We have all worked in times past on various issues.

I called 311 today and made the first of what looks like will be several incident reports. If I am assaulted once, in any way shape or form I will not just take it, and I will be encouraging residents to not just lean on me to bitch to but to get proactive and call VPD and 311 relentlessly if needs be. I am waiting on The City of Vancouver to send me the file number via email. The music was so loud the COV operator could not hear me properly on speaker phone today.

We are also asking you at this time to help us comprehend how your tennant The Aboriginal Front Door was allowed all these concessions over the last two years, concessions that have turned our front door into a fetid pit of all manner of bodily and other waste. Rats and Cockroaches abound, so much food waste left by AFD that rats literally are getting fat and brave, even nesting in car engines that are parked on Main street using as nesting material the food containers that they provide!

Today there could not even be a 20 minute meditation session at The Listening Post by reason of the noise and flurry of people in today's food line up. It is a 22 year tradition and one clearly cherished by the community who live here and not a transient one but members of the actual community that contribute to the wellness of one another!  TLP is not there to turn away people by telling them it is not a dinning hall, and volunteers and the community will most certainly stay clear of the gong show if this continues, it has already happened earlier this year when AFD was serving food out the door all day long!.

In your social policy planning expertise how can this be good social planning for the people who call BEP home? Do you know how stressful it is to live and volunteer on this corner already?

We need you to look after our interests first. I truly hope you will and stop the erosion of the demonstrable detriment to the peaceable enjoyment of the tenants.

Please, this will not go away on it's own and it has come to the point where I / we have to speak and act in order to regain the peace that is being breached here. Those who camp out in tents across the street and blair their ghetto blasters and party, fight, and revel all night long is more than enough of a pain, how or why would we facilitate or keep quiet about something that is within our purview to take action and change?

  3. Noise on Private Property Case Created – #201000121716

There has been a setting up of 3 BBQ grills and various kitchen equipment and Event tents, and Loud Speakers over the last week. Today is the second time this week. I have phoned 311 on Thursday regarding the noise and nuisance faced by both residents and the Non profit "The Listening Post" @ 382 Main Street.

They are providing free meal/s to the general population, as well as playing loudly various types of recorded and live music on a public PAS system including live drumming.

The food line up goes down the block and the main bottle neck is right in front of the residents of 380 Main Streets (Bruce Eriksen Place) principle apartment entrance.

There are 38 apartments (Not SRO's) and the noise, the crowds, the food and container waste thrown on the ground and in the entrances of our home, and people defecating and urinating in our entrances is making this and Untenable Situation for Residents @ 380 Main Street.

Bruce Eriksen Place is a home to about 45 people, a mix of low income workforce and Persons with Disabilities. We are not an assisted living facility, we are group of peaceable residents and a building that does not "tax" emergency services as is so common in the DTES.

The patio space that took up parking in front of the building went up with out any public notice and or consultation with the residents @ 380 Main Street.

Residents have been struggling with The Aboriginal Front Door's feeding program for close to two years now. It has been a detriment to the safety of the residents due to the concentration of people in the DTES fighting in the lineups, impeding residents ability to without hindrance come and go from their entrance, having time and time again people using our entrances as a place to relieve themselves, use the entrance  / door way as a place to consume the meals handed out and a to dump their food and containers there as well. In addition trying to gain unauthorized entrance to the apartment when residents enter or exit the building, at times producing verbal assaults, shoving and many threats of violence for not giving access to people accessing the services provided at and by The Aboriginal Front Door.

Again " This is an Untenable Situation for Residents @ 380 Main Street. " Please do visit the Internet links provided.

We need relief and remedy so as to have quite and peaceable enjoyment of our tenancy. We need the City of Vancouver to intervene.  I make this report and appeal on behalf of several residents
